§ 10-3.103. Findings, authority.

  • (a)

    Findings. The Board of County Commissioners finds that:

    (1)

    The requirements and standards of this article for transportation facilities are necessary to ensure the public benefit of safe and convenient travel, as well as maintaining the ambient air quality in the county.

    (2)

    The number of property damage and injury accidents increase as congestion increases on the roads, and that fire, rescue and law enforcement response times increase as traffic congestion increases.

    (3)

    The standards and requirements in ordinances for parks, potable water, sanitary sewer, solid waste, stormwater management, and mass transit are necessary for the health, safety, and welfare of the citizens, and protection of the environmental and natural resources of the county.

    (b)

    Authority. The Comprehensive Plan was adopted by the county, pursuant to the requirements of F.S. § 163.3184 by County Ordinance No. 90-30 [see Article II of this chapter]. The county is required by the provisions of F.S. § 163.3202 to adopt land development regulations within one year of the Comprehensive Plan's submission to the state department of community affairs that provide that public facilities and services meet or exceed the standards established in the capital improvement element of the Comprehensive Plan, and that the county shall not issue a development order or permit which results in a reduction in the level of services for the affected public facilities below the level of service provided in the Comprehensive Plan.
